A
Judicial Court sentenced a Madison County man to 20 years in prison for
security violations.
Harry
"Woody" Duncan was convicted of violating the Alabama Securities Act. Investigators
said he wrote an unregistered promissory note for $25,000 and said the
investment would provide "double digit returns."
Duncan will be required to serve five years of the 20 year sentence. Fifteen years were suspended under the conditions he make full restitution to the
victims and file sworn quarterly financial statements.
Duncan pled guilty to scheme or artifice to defraud in connection
with the sale of securities and theft first degree.
The
court ordered Duncan to serve an addition 15 years for the theft charge to run
concurrent with the securities fraud case.
Duncan
will have to pay $512,063 in restitutions to seven investors named in the original
indictment and an additional $179,000 to another victim.
Duncan
will have another restitution hearing to determine if additional repayments are
owed to other victims on November 19.
