Attorneys representing both the defendants and the plaintiffs in Hammad Memon's civil lawsuit wrapped up a status hearing on Thursday.
The attorneys set a framework for how to proceed with educational records that may be requested of Hammad Memon as the case prepares for trial, which attorneys projected to begin by early next year.
The hearing addressed not only educational records of Hammad Memon, but for other students at Discovery Middle School as well -- should they be requested.
Educational records requested by the court in this case are protected under a federal law known as FERPA, or the Federal Educational Rights and Privacy Act.
It requires the court notify a student and his or her parents about any disclosure of educational records in a trial.
Woody Sanderson, who represents Madison City Schools Superintendent Dr. Dee Fowler and former Discovery Middle School principal Sharon Willis, said no records have yet been requested.
"Obviously, my clients as the superintendent and principle have access to educational records. Their ability to disclose these records is limited under federal law. Even if there's a court order to disclose them, we're still under an obligation to notify the student and parents that the court ordered to disclose the records," said Sanderson.
Memon's criminal trial is also pending. The teen is charged with murder for killing classmate Todd Brown at Discovery Middle School in Madison in 2010.
He remains in jail without bond.
