JACKSON COUNTY, AL (WAFF) -
Late Thursday afternoon, a judge approved a stay in James Davis's case.
Davis was fighting to keep his wife's final resting place in their front yard in Jackson County.
Davis has to file proper notice of appeal and take out a bond approved by the court for the stay to go into effect.
Davis buried his wife at their home in Stevenson.
He said it was her dying wish to be buried there.
