Another round of testimony ended for the day in a Marshall County arson case.
A mother and son are on trial for the 2008 fire at their home.
The judge threw out the arson charge against Kennamer. The theft by deception charge will be the only charge remaining when court resumes Friday morning.
State arson investigators said the cause of the fire was undetermined, but their investigation into the home burning began approximately four months before the fire.
Prosecutors continued putting on witnesses in the arson trial of Ella Kennamer on Thursday.
Kennamer was charged with the 2008 burning of her home in Grant along with her son, Donald Jones.
Former state fire marshal Bobby Rollins testified they began an investigation into the case in December 2007 when they received word from Jones' girlfriend that there was a plan to burn down the home for insurance money.
After a month long surveillance, the home never burned and Rollins testified the state needed resources to go elsewhere.
When the home did burn in March 2008, Rollins testified the state heard about the fire a month later.
By that time, Rollins said the insurance company had contaminated the scene.
Through further information from Jones' girlfriend and insurance company records, Rollins testified they were able to obtain from a mobile home and two Hampton Cove storage units items that Kennamer listed to the insurance company as having burned in the fire.
The state rested their case on Thursday and the jury was released until Friday at 9 a.m.
