A judge denied the request to overturn capital murder indictments in a 2011 case.
John Junior Milton and Jessica Nunley were charged in April for the stabbing death of David Pennington. Investigators said the man was killed following a robbery of his Lauderdale County home.
Attorneys for Minton and Nunley said because they didn't list aggravating factors that would constitute the death penalty.
The death penalty or life in prison without the possibility of parole are the only sentencing options for a capital murder conviction in Alabama.
