HUNTSVILLE, AL (WAFF) -
Law
enforcement officials are now allowed to determine legal status checks on
anyone they pull over after the Arizona Immigration ruling.
The
Alabama immigration law is modeled after Arizona's, so there may be a large
impact whenever Alabama authorities pull someone over.
Officers
are trained annually and some of the training will involve implementing the
immigration law. However, just because officers can ask about legal status does
not mean they will detain anyone.
Legal
analyst Mark McDaniel said even if an illegal immigrant does not have a driver's
license, authorities can only inform immigration services.
"You
could pull them over for not wearing a seat belt but it's not a crime now not
to possess your federal registration card so that wouldn't cut it," said
McDaniel. "You would have to have some kind of crime that you observe that you
have probable cause to see if they've committed a felony or major misdemeanor."
A ruling
on Alabama's immigration law is expected to come out of the 11th Circuit Court
of Appeals in the next few weeks.
