Jury finds Jessie Phillips guilty of capital murder

A Marshall County jury found Jessie Phillips guilty of capital murder.

Jurors had to chose between capital murder, murder, and not guilty. The defense rested its case Monday morning and closing arguments started shortly after.

The judge charged the jury later in the afternoon and they deliberated for an hour and a half. Phillips did not show any emotion when the guilty verdict was read.

Phillips killed his wife, Erica Droze, and her unborn child at a car wash in 2009.

This was Alabama's first case where the Brody Bill was applied. The law allows for the death penalty in capital cases involving women who are murdered while pregnant.

Droze was eight weeks pregnant at the time of her death.

The jury will return Tuesday for the penalty phase. Since Phillips was found guilty of capital murder, he could face death.
