MADISON COUNTY, AL (WAFF) -
The Madison County District Attorney filed a motion late Friday afternoon requesting the judge order a mental evaluation for Hammad Memon.
Memon's attorney plans to use the insanity defense when the teenager goes to trial for murder.
Memon is accused of shooting and killing 14-year-old Todd Brown during a class change at Discovery Middle School in 2010. His trial was supposed to happen this summer but has been delayed.
Memon's attorney requested the delay after his client was arrested in Dallas. Police think he was trying to flee the country before his trial. Memon was there with his mother, Safia. Police said Safia Memon had Pakistani passports and a large amount of cash. Once returned to Madison County, Memon was placed in the Metro Jail without bond. Memon's parents Iqbal and Safia Memon are charged with hindering prosecution.
Prosecutors want a forensic examiner with the Department of Mental Health to examine Memon since attorneys say he is not fit to stand trial.
