LIMESTONE COUNTY, AL (WAFF) -
State Attorney General Luther Strange is suing Ardmore's Water Works and Sewer Board over alleged violations of the Alabama Water Pollution Control Act.
The lawsuit, which was filed with the Limestone County Circuit Court, claims the wastewater treatment plant on Jones Avenue has been discharging pollutants at a higher rate than the Alabama Department of Environmental Management allows.
A copy of the lawsuit obtained from Strange's office documents 144 instances when the levels of specific pollutants were allegedly higher than the limit from August 2007 through October 2011.
Strange asks the court to allow a $25,000 fine for each violation. In total, that adds up to $3.6 million.
According to the environmental organization Tennessee Riverkeeper, that group has also filed a civil suit against the Ardmore Water Works and Sewer Board. According to the group's press release, they discovered more than 2,000 violations of the Federal Clean Water Act.
Attorney Patrick Anderson, who represents the Ardmore Water and Sewer utility, said it is too early to comment, noting that they just received the legal documents related to the lawsuit Wednesday.
