MADISON, AL (WAFF) -
Hammond Memon is accused of killing his classmate in 2010. Memon allegedly shot Todd Brown at Discovery Middle School in Madison.
A civil lawsuit was brought against Madison City Schools following the shooting. The lawsuit claims school leaders should have known Memon was a threat. He had enrolled at Discovery Middle after he left the Patriot Academy due to disciplinary issues.
Next month a judge will consider dismissing the lawsuit.
The Madison city board of education, Superintendent Dr. Dee Fowler, and Former Discovery Middle School Principal Sharon Willis are the defendants in this lawsuit. They claim they are not responsible for the shooting. An attorney for the defendants said they had no reason to believe Memon would bring a gun to school and shoot Brown.
Memon and his parents are also named in this lawsuit.
The judge presiding over the lawsuit will listen to attorneys arguing for and against dismissing the case on April 20.
Memon is charged with the murder of Todd Brown. He does not face the death penalty since he was 14 at the time. His trial is set for July.
