HUNTSVILLE, AL (WAFF) -

Huntsville couple Alvin and Rose Gibson filed a 12 page lawsuit against their insurance company over April 27th storm damage to their home.

Court documents claim a tree left huge holes in the roof, damaged the foundation, snapped a water line, and ruined most of the couple's personal belongings. WAFF 48 attempted to contact the couple, but their lawyer advised against the Gibsons talking to us.

Anna Clark lives across the street from the Gibsons. She said the couple hasn't lived in the house since the storms. Court documents show FEMA and a contractor declared the house a total loss, but those documents claim the Cotton State's Mutual Insurance Company didn't help remove the trees with a crane until June. The company put a tarp over the holes, but the Gibson's belongings were already ruined.

Next door neighbor Lenel Walton calls the Gibson's fight an on-going battle. Court documents claim in late June, Cotton States Insurance tried to send the couple a $24,000 check even though the house appraised for nearly five times that amount.

The couple's lawyer believes his clients are due a new home, money for damages to their property, money for their living expenses while they've waited for the insurance company to pay up and reimbursement for their moving and storage expenses.
