Charges have been dismissed against a Marshall County man whose dogs allegedly attacked an elderly Arab woman.

As it turns out, Marshall County's animal control officer who filed the charges failed to show in court.

Without a witness, the judge dismissed the case.

Richard Sloan had been charged with dogs running at large, but now those charges are dropped.

The charges stem from an incident where Eunice Hyatt was brutally attacked in the face by dogs, which put her in the hospital and subsequent therapy.

The incident happened at Hyatt's home off Ruth Road last October when she was with her niece at her carport.

Hyatt has said this isn't the first time Sloan's dogs have gotten out and threatened her.

Neighbors also tell WAFF 48 News the same, and some say they've felt like prisoners in their own homes because of it.

Because Sloan wasn't found not guilty, prosecutors say the charges can be brought back up.

One prosecutor said he plans to reinstate those charges next week.
