HUNTSVILLE, AL (WAFF) -
The Alabama Supreme Court issued a ruling in the wrongful death of an unborn DeKalb County child. The ruling gave unborn children right's at the act of conception.
The case involves a DeKalb County pregnant woman, Amy Hamilton. Hamilton filed suit against several doctors and a medical group. She claimed her unborn child died because of lack of proper medical intervention.
The Alabama Supreme Court issued a unanimous ruling in favor of Hamilton saying an unborn child is a unique human being at every stage of development. Legal experts tell WAFF it won't stop Roe v. Wade, though.
Pro-Life groups are applauding the decision. Liberty Counsel, a non-profit group that fights for the social issues, including the sanctity of marriage, called the decision landmark.
"I think it's a big chop by an axe at the base of the Roe v. Wade tree. I don't know if it will make it fall at this time, but it puts a big ding in the tree, and I think it sets the philosophical foundation for undermining Roe v. Wade," said Liberty Counsel's Mathew Staver.
But Pro-Choice groups don't believe the ruling will have a major impact.
"My take is that the right to choose is still alive in Alabama," said Alabama ACLU spokesperson Allison Neal.
