Huntsville man charged with arson acts as own attorney

HUNTSVILLE, AL (WAFF) -

A Huntsville man indicted on arson and assault charges went to trial Wednesday. Danny Cherry decided to represent himself in front of the jury.

Cherry walked into the Madison County courtroom Wednesday ready to represent himself on his arson and assault charges stemming from September 2008. Police say he intentionally set a fire at an apartment off 13th street in Huntsville.

Firefighters had to break the door down to get Jarvis Chapman and his mother out. Just days before the fire, police say Cherry stabbed Chapman with a knife.

Before the trial began, Cherry asked Judge Dennis O'Dell to recuse himself.

"I've been denied my legal right throughout this entire trial and it's not fair. That's why I filed a civil suit with the court of Alabama. I believe they are maliciously prosecuting me because I am a homosexual and it's been stated by numerous attorneys. I am not guilty," said Cherry.

Cherry pleaded not guilty by reason of mental disease or defect.
