Mother talks about lawsuit over death of her pregnant daughter

WAFF 48 News spoke with a woman who is suing her late daughter's former landlord.

Her daughter died in a house fire two years ago in Fort Payne.

"She was my first born," said Tracy Haire.

For Haire, the death of her daughter, Sherry Ann McCauley, feels like it was yesterday even though it's been two years.

McCauley died while she was four months pregnant in a house fire January 4, 2010 in a home on Gault Avenue South in Fort Payne.

Like many, Haire had questions.

"What happened?  Why it started?" she asked.

But Haire said she never got those answers.

"I left three months after she passed away because I couldn't handle it and just moved back," said Haire.

And when she moved, she continued digging to find answers.  This time she found out.

"The fire department told me there were no smoke detectors," she said.

That left Haire feeling her daughter should be alive.

"I want justice," she said.

The home is cleared off the lot, but Haire filed suit this week against Hilyer Properties, who rented to her daughter.

In the form of a tattoo, a tribute to her daughter is forever ingrained into Haire's arm.

She hopes her legal actions may help save the life of someone else.

"How many houses does he have that are like this?  And why aren't they inspecting his houses if he's renting them out?" she asked.

We put in calls to Gary Hilyer at Hilyer Properties for a response to the lawsuit. So far, we've not been able to reach him.
