New information about alleged assault by Rolando McClain

If Rolando McClain carried a pistol the night he allegedly used a handgun during an assault in Decatur, he did so legally.

Morgan County Sheriff's Office officials said the former Alabama Crimson Tide football star renewed his pistol permit Wednesday, hours before the alleged assault.

23-year-old Rishard Papscott told Decatur Police investigators that McClain and Jerradius Willingham physically assaulted him at a home on Skyview Street. As Papscott crawled to his car, McClain allegedly put a gun to his head then fired a shot past the victim's ear.

Decatur Police investigators said they did not find the gun allegedly used, and that they are not looking for it.

McClain's arraignment before a city magistrate is set for January 24th. He could enter pleas to the charges at that hearing.

If convicted, McClain faces four misdemeanor charges. If convicted for all of them, he could face a maximum of 480 days in jail.

Here are the sentencing guidelines for each charge: up to 180 days in jail for third degree assault;180 days for reckless endangerment; 90 days for menacing; and 30 days behind bars for discharging a gun within Decatur city limits. The longest probation period he could receive would be two years.

Willingham is charged with third degree assault.
