Marshall Co. judge to decide if pharmacist is to be evicted

MARSHALL COUNTY, AL (WAFF) - An eviction hearing was held\ Tuesday for an embattled Marshall County pharmacist currently facing drug charges himself.

62-year-old Timothy Neal Bishop is currently out on bond after he was charged with 3 counts of distribution of a controlled substance.

His criminal case never came up in the court hearing.

The landlord maintains he consistently pays his rent late, but Bishop's attorneys learned that it might not be the real motivating factor.

Timothy Neal Bishop testified at the hearing in Albertville concerning his Scant City pharmacy.

He told the court he paid late because insurance often pays late and he had an oral agreement with the late owner, Luther Latham, that his rent could be paid late.

Latham died last August and the building is now in the hands of Latham's sister, Jean Isbel.

Isbel testified late in the hearing that she would like to evict Bishop so Latham's son Barry could return to the pharmacy business.

The judge is expected to rule in the next 14 days.
