Jacob Shaffer indicted on capital murder in Huntsville

FAYETTEVILLE, TN (WAFF) - A man accused of six murders in Southern Tennessee and North Alabama has been indicted by a Madison county Grand Jury on capital murder charges.

Jacob Levi Shaffer is accused of stabbing to death his estranged wife Traci Shaffer, her son Devin Brooks, his friend Robert Berber Brock, Traci's father Billy Hall and her brother Chris Hall.

He's also accused of beating Sidney Dempsey to death at a Huntsville business.  No charges have been filed over the Huntsville killing.  

Madison County Assistant District Attorney Jay Town says the theory behind the capital murder charge is that Shaffer committed murder while in progress of a burglary by killing Sidney Dempsey.

"The state's theory is that he did go to Dempsey's dwelling, even though it was a business, that was his home, where he slept, where he hung his hat at night, with the specific intent of killing Sidney Dempsey," said Town.

The marble company was owned by the family of Shaffer's estranged wife, Tracie. The next day she was found stabbed to death, along with her 16 year old son, her son's friend, her dad and brother. Shaffer is charged with capita murder.

Prosecutors in Tennessee have asked an appeals court to reverse the ruling of the trial court disallowing statements Shaffer made following the murders from being admitted into evidence.

Town, who is one of the lead prosecutors says when Shaffer's murder trial begins here, the court will allow his statements to be used.

"We do have lots of evidence that supports conviction of capital murder in Madison County," said Town.

Shaffer has not been officially arrested for the murder of Sidney Dempesey in Alabama.

Those charges will come after he is tried in Tennessee.
