HUNTSVILLE, AL (WAFF) – Former State Representative Sue Schmitz filed a motion for more time before she reports to prison.
The motion put before the court Wednesday outlines two reasons that Schmitz should not have to report to prison by December 4. One reason is her appeal of the judge's order denying her motion to remain on bond pending appeal. The second reason raises issues about vagueness in the indictment.
Schmitz was sentenced to 2 years and 6 months in prison after being convicted in February on fraud charges.
She also is to pay $171,000 in restitution after doing little work for the two-year college system.
