Circuit judge hears jail lawsuit

Is the lawsuit involving the original contractor on the Huntsville-Madison County Jail any closer to a decision?

A Birmingham judge says depending on what attorneys decide it could take years to finalize.

More legal red tape in the lawsuit against general contractor Dawson Building Contractors. Subcontractors who worked on the Huntsville-Madison County Jail want dismissed from the suit.

Inside Jefferson County Circuit Judge Robert Vance's courtroom, the Public Building Authority and Dawson Building Contractors argue their case.

Dawson asked the court to consider judgement against its insurance company, Amerisure Mutual of Michigan.

Court papers show Amerisure breached the insurance argument by refusing to defend or hold Dawson harmless over the authority's allegations.

Judge Vance says he reviewed the motion and granted summary judgement in the matter.

There's also the issue of some ten subcontractors who want their name taken off a lawsuit involving Dawson Contractors and the PBA.

Attorneys for the subcontracting group say all obligations on their part for quality and completion of the work ended when the authority fired Dawson for convenience and not for cause in 2006.

They are asking for the case to be dismissed.

The judge says he's not ready to make a decision in the case and needs more time for review.
