
A family whose children were injured in the airshow accident last month have filed a lawsuit against the Huntsville Airport Authority and the company that provided tents for the airshow.
It's the first lawsuit to be filed.
Wanda and Thomas Cross and their three children were at the airshow heading for the VIP seating area when the microburst hit.
All three of their children, ages 5, 6, and 10 received injuries when a tent collapsed on them.
The six year old suffered the worst, including facial lacerations and head trauma.
Brent Jordan of Jordan and Greer is representing the Cross family.
He says the liability falls in the hands of the Huntsville International Airport and All Needz Rental Incorporated, the company that supplied around 80% of the tents.
Jordan says neither the airport nor the tent company followed the proper procedure for setting up tents, including not getting a permit from the city.
He says the tents were not properly staked and says the tragedy could have been prevented.
The airport has yet to return WAFF 48's call.
Steve Whitman, President of All Needz Rental, issued the following statement: "As I have mentioned during previous interviews, our thoughts and prayers go out to the family of Josiah Miller. Additionally we're praying for all of those involved in this tragic act of God. We would ask that our community also pray for those same individuals as well as our family. We have contacted our insurance company and they are currently investigating this incident. We have no furthur comments at this time."
