
A man was shot and killed just after midnight Sunday on Webster Drive.
Huntsville Police have not filed any charges against the alleged shooter.Investigators believe the shooting was in self-defense.
According to authorities, Huntsville police received a 911 call about a possible shooting at 1002 Webster Drive shortly after midnight Sunday. When emergency crews arrived on the scene they found the body of 34-year-old Gary Lee McCarty. He was found at the rear of the apartment building.
Investigators say McCarty was drinking and locked himself out of his apartment. He tried to crawl through a back window but it was the wrong apartment.
McCarty was shot to death after the owner of the apartment thought he was someone trying to break in. Neighbors say they hear gunshots occasionally in the area and did not think someone was actually shot.
"You get used to it and say 'ok somebody just shooting their gun off.' But you never think you would find a dead body in your back yard," said Wanda Russell.
Investigators will present the case to the Madison County District Attorney's office to give to a grand jury.
