New Documents Uncovered In Adoption Battle

New details in the adoption case regarding Deanna Baldizan. WAFF 48 News has uncovered court documents that paint a picture of violence and abuse.

After a custody hearing Wednesday, Deanna Baldizan's father Jesse Baldizan told reporters he's relieved his little girl is back in California. She arrived Tuesday night from Alabama, after living in Athens with an adoptive family and her biological sister since March. Deanna was placed there by her mother, Ilene Hill.

Now, Deanna is in the custody of her paternal grandmother. Janice Wise filed for temporary custody of Deanna, not her father Jesse Baldizan who claims he never consented to the adoption.

"Jesse's the father. As long as he does what he's supposed to do, and he can take care of her, it's no different than you guys raising your kids," says Wise.

But court records paint another picture. A complaint filed by the District Attorney two years ago alleges that Jesse Baldizan beat up and threatened to kill his girlfriend Ilene Hill, Deanna's mother, while she was holding Deanna in her arms. He plead no contest to a lesser charge.

In the court records we also found the current probation order for Jesse Baldizan and it includes a condition that says do not harrass, threathen, annoy or contact his young daughter.

And we found a current restriaining order that says he should not come within a hundred yards of his daughter. This restriaining order is supposed to be in effect through at least July of next year.

Yolo County Assistant DA Frank McGuire, who is making this a case about father's rights, said Thursday he didn't know about the charges, "Restraining order, no, I didn't know about it, it happened in 2003."

But wait, we made it clear before he left Alabama with Deanna Tuesday that he knew the potential danger he was sending her back into.

Lee Marshall: "So you are fine with the fact that you are knowingly sending Anna back today to a home that has a history of domestic violence a history of abuse, has a history of a father that does not pay child support, that does not have a job, that does not have a house"

Frank NcGuire: "It's about father's rights."

Lee Marshall: "If it's an issue of father's rights then why isn't Jesse here to pick up Anna today?"

Frank McGuire: "Because the courts have granted a guardianship to grandmother."

Until Wednesday, Jesse Baldizan was living with his mother, Anna's grandmother. As a result of our investigation he was ordered out of the house.

Deanna will continue to live with her paternal grandmother, who has been granted temporary custody, until permanent custody is decided by a judge.
