Teacher charged with sex abuse could face strict prison time

The charges against Harvey Knotts are not only shocking, but serious.

If convicted Knotts could spend up to 20 years per count in prison.

These statutes run down sexual abuse of a child less than 12 years old, the definitions of sex abuse, and why the school is forced to continue to pay knotts until his case is resolved.

The law regarding charges filed by Huntsville Police against 4th grade teacher Harvey Knotts is clear. A person who commits the crime of sex abuse of a child less than 12 years old, is considered a felony.

Police arrested Knotts on seven counts of sex abuse, involving five victims.

WAFF-48's Legal Analyst Mark McDaniel says if convicted, Knotts could face up to 20 years in prison on each count.

"Its a very serious offense this could be multiplied by the fact that you have multiple victims in this case," said McDaniel.

Police say the alleged sex abuse happened at McDonnel Elementary School, where Knotts is employed.

The school system tells us Knotts is on paid administrative leave, but with these allegations against Knotts, why haven't they already fired him?

McDaniel says its not that easy. By law Knotts will remain on leave until the charge is adjudicated.

If he's convicted, the school can get rid of him. McDaniel says there's nothing easy about this case.

"Its bad. Its terrible. It's a tragedy but I'm sure its something the DA's office, we've got one of the best in the country, they'll do a great job on it," said McDaniel

Knotts remains in jail tonight on a $140,000 bond.
