State issues Corps of Engineers dredging violation

Associated Press - December 4, 2009 10:35 AM ET

MEMPHIS, Tenn. (AP) - The state has issued a notice of violation against the Corps of Engineers for improperly dumping dredge material that killed fish in Wolf River Harbor at Memphis.

The Commercial Appeal reports that the Tennessee Department of Environment and Conservation issued the violation after preliminary investigation of the fish kill in October and November.

The investigation revealed that the material was dumped into a wetland area adjacent to the harbor, and it somehow re-entered the harbor.

Corps officials say the improper disposal was "self-reported" to state officials and that the Memphis district is conducting an internal investigation into the incident.

The corps was given a Dec. 23 deadline to submit a written response to the violation.
