Shoals man charged with trying to kill a 2-year-old

RUSSELLVILLE, AL (WAFF) - A Shoals man has been arrested for attempted murder.  He is accused of trying to kill a 2-year-old boy.

The incident happened on Sept. 22.  Emergency officials arrived at the scene to find the 2-year-old not breathing.

The boy was hurt at the Washington Court Apartments.  He was flown from Russellville after being found unresponsive.

Richard Edward Agee, Jr., of Tuscumbia, has now been charged for trying to kill the child.

"It's been determined that basically the only way that child was injured that way was by being shaken violently," said Chris Hargett, Russellville Police Chief.

The boy was not related to Agee.  He was just visiting the residence.

"This was his girlfriend's child," said Hargett. "He was actually babysitting the child and another child while the mother was at work."

Investigators said the child has now been released from the hospital but is still under very close medical care.

A warrant was issued Wednesday for Agee's arrest after investigators determined the boy's injures were intentional.

Agee could face up to 20 years in prison if convicted. He is currently being held in the Franklin County Jail.
