
BIRMINGHAM, AL (WAFF) - The forfeiture hearing for a former state representative wrapped up late Thursday morning.
Sue Schimitz owes the state some $177,000 in restitution and a $177,000 in fines for a total of $354,000. On Thursday, the government asked the court to substitute her two homes and property for the money judgement.
The judge decided to give Schmitz the opportutnity to pay the $354,000 before taking her property. The two properties are her home on Jeff Road in Toney, as well as her beach home in Panama City Beach, FL.
The value of the two homes has not been determined.
In February, a jury found Schmitz guilty of fraud offenses and in July the court sentenced her to prison and to pay the $177,000 in back pay for a job they said she did little to no work for.
Government attorneys said her current assets won't cover the money owed. That's why they're wanting to substitute the property.
Jake Watson, Schmitz's attorney, told WAFF 48 News that the big question now is how is she going going to pay the money owed, and that's up in the air.
