DECATUR, AL (WAFF) - Closing arguments will be heard Wednesday in the Daniel Wade Moore murder trial.
The defense rested Tuesday, but the prosecution called more witnesses in rebuttal
For the third time, a jury will decide the fate of Daniel Wade Moore.
Moore is accused of killing Karen Tipton, March 12, 1999.
Before any testimony at the courthouse, the judge asked if Moore would testify.
He said no and the judge explained Moore has the right, even if his attorneys advise him against it.
During defense testimony Tuesday, Michael Todd Jones, a "witness and paver, told jurors a white truck arrived about an hour before the police came and never moved.
The defense then rested.
"Normally when the defense rests, the case is over. But it's not unheard of and the rules provide for the state to present rebuttal witnesses to rebut some of the defense's witnesses," said attorney and courtroom analyst Scott Anderson.
When these witnesses are called, there are some tight restrictions.
"They are limited to the matters that were brought up in the defenses case," said Anderson.
The defense could also call rebuttal witnesses.
Two former co-workers of Dr. David Tipton gave jurors a timeline of the day of the murder, as did pharmacist Dwight Tipton.
Investigator Barry Hamilton also said police interviewed people who backed up the doctor's story, indicating he could not have killed his wife.
At one point, Alabama Attorney General Troy King came to the courtroom to rally his prosecution team.
Closing arguments will be Wednesday morning.
