DECATUR, AL (WAFF) - There are new developments in the Daniel Wade Moore murder trial. Moore is suspected of killing Karen Tipton in her home in 1999.
Daniel Wade Moore has tested negative with a DNA hair test, but his bond was revoked because of a positive drug/urine test.
There was another surprise at the end of the first day of testimony.
A new hair test shows Daniel Wade Moore did not have THC in his system.
It could make a difference in Moore's trial, and that's why the judge wants everything he can get his hands on everything he can before he rules on whether to release Moore on bond again.
The judge says he has 2 conflicting tests and needs evidence to determine which one to believe.
"The people who actually conducted the tests or conduct similar tests can come in to testify about that tests reliability," said courtroom observer and Decatur attorney Scott Anderson.
Anderson believes the urine test is most reliable for more recent tests.
Opening arguments had the defense pointing an accusatory finger at the victim's husband, Dr. David Tipton.
They implied Tipton's wife was looking at his e-mail and found pornography and confronted him.
They argue the person who killed Karen Tipton knew her.
The prosecution says it has to be Moore.
They maintain the DNA evidence will prove Moore is guilty.
Moore's uncle Herman "Sparky" Moore testified Daniel Wade Moore confessed to being in the house when Tipton died, but denied killing her.
Daniel Wade Moore later recanted that statement.
A separate hearing will take place on Moore's bond.
Lawyers from both sides can argue which test is best. The hearing has not been set.
