Hearing set in murder case with botched autopsy

Associated Press - April 9, 2009 11:24 AM ET

CARROLLTON, Ala. (AP) - A west Alabama woman could soon be cleared of a capital murder charge in the death of her stillborn baby.

A judge set a hearing for Thursday in Carrollton in the case against Bridget Lee, a longtime church pianist.

The 34-year-old Lee was charged with capital murder and spent nine months in jail after authorities charged her with murdering her baby in 2006. She conceived the child during an extramarital affair.

The first autopsy by a state examiner determined the child was born alive and was suffocated in a homicide. The defense challenged the finding, and state experts now say the baby died of pneumonia and never drew a single breath.

The doctor whose autopsy led to the murder charge left Alabama and now works in Texas.
