HUNTSVILLE, AL (WAFF) - The Huntsville police officer who is facing murder charges after a deadly shooting in 2018 is appealing a ruling that he is not immune from prosecution.
Officer William Darby is accused of murder after shooting and killing a suicidal man who refused to drop his gun.
Darby claimed it was self-defense.
Judge Donna Pate denied Darby immunity earlier this month.
The court will either reverse Pate’s decision to not grant him immunity or uphold her ruling.
